MEMORANDUM OF AGREEMENT (MOA)
Air Force Instruction (AFI) 10-2501
Emergency Management (EM) Planning and Operation, dated 24 Jan 2007
And AFMC Supplement
1, dated 30 Jun 2007
- American Federation of Government Employees (AFGE)
Council 214 and Air Force Materiel Command (AFMC), hereafter referred to
as the Union and Management, hereby enter
into this MOA regarding subject instruction and supplement as they apply
to bargaining unit employees (BUEs) in matters covered by the Master Labor
Agreement (MLA) between the parties.
- The Parties agree emergency management is an
essential function within AFMC. The
changes introduced in the above titled instructions impact Emergency
Management (EM) employees with the Civil Engineering (CE) squadron at each
base. Management has determined
that no positions will be cut and no adverse actions will occur as a
result of these changes.
- At affected installations, approximately four to
eight GS-301/GS-343 BUEs are situated in the EM flight. Some number (not necessarily all) of
these positions will be converted to emergency response positions. They will retain their primary duties
but also be prepared to respond during terrorist use of Chemical
Biological Radiological Nuclear (CBRN) incidents. This will require extensive training in
HAZMAT procedures and use of CBRN
detection equipment. It will also
impose physical fitness and health
requirements, similar to fire fighters. These additional skills and experience
will be documented in the affected employee’s record, in accordance with
the MLA.
- The Parties recognize that not all current EM
personnel will be able to meet the medical and/or physical
qualifications. Management will
solicit volunteers within the flight to perform secondary emergency
response duties. If the required
amount of volunteers is not met, management will assign the secondary
emergency response duties to the best qualified employee(s) who meet the
medical and/or physical requirements/qualifications in a least seniority
order. EM personnel who become
medically and/or physically disqualified after assignment of emergency
response duties will not be required to perform such duties, and will
retain a position within the flight.
If a replacement is to be administratively reassigned to a vacant
emergency response position, the most senior qualified volunteer will be
selected or, if there are no volunteers, the least senior qualified
employee will be selected.
Displaced employees, if any, will be placed on vacant positions for
which they are qualified.
- Management will provide all required responder
training in accordance with appropriate guidance to include qualification
time lines and certifications
Employees will be given time to study and practice for certification
testing. Opportunities to retest
will be provided, as needed, to obtain certification.
- Responders who suffer injury and become medically
disqualified for their emergency response duties will maintain primary
duties, but will not be required to perform secondary/alternate emergency
response duties during recovery period (up to 6 months). If recovery period exceeds 6 months,
employee will be placed on a position without emergency response duties
for which they are qualified.
- All remedies available under the MLA or 5 U.S.C.
Chapter 71 are available to the parties if either
party believes the other has failed to comply with any of the requirements
of this MOA.
